1. PARTIES

These Terms of Use are entered into between the users of the platform operating under the domain name aihane.com and the service providers whose details are set out below:

2. SUBJECT MATTER

These Terms of Use govern the conditions relating to users’ access to the AiHane platform, creation of membership accounts, use of the platform, generation of content, upload of files, and use of free or paid plans.

3. PLATFORM SERVICES

AiHane may offer AI-supported text-based chat, image generation, clothes changer, background changer, image/audio/PDF upload, gallery management, history display, user feedback features, and similar digital tools.

Services, features, usage limits, access rights, commercial use conditions, and plan contents within the scope of the platform may be updated, changed, restricted, or removed from time to time.

4. MEMBERSHIP AND ACCOUNT SECURITY

The user agrees that the information provided during registration is accurate, current, and belongs to the user. The user is responsible for safeguarding the username, password, and account access credentials. Transactions carried out through the account shall be deemed to have been performed by the user unless unauthorised use is clearly demonstrated.

AiHane reserves the right to suspend or terminate accounts created with false, misleading, unlawful, or third-party information.

5. PROHIBITED USES

The user agrees not to engage in the following actions:

Producing, uploading, sharing, or processing unlawful content,
Producing content that includes insults, threats, hate speech, discrimination, harassment, or incitement to violence,
Violating the personal rights, privacy, copyright, trademark rights, or other intellectual property rights of third parties,
Using the platform for fraud, phishing, spam, forgery, or manipulation purposes,
Conducting activities involving malware, malicious code, or actions threatening system security,
Gaining unauthorised access to the platform, performing reverse engineering, overloading the system through automation, or disrupting the service.

6. USER CONTENT

The user is solely responsible for all content uploaded, processed, transformed, generated, or stored on the platform. The user represents that they hold the necessary rights to the uploaded files and generated content or are legally authorised to use them.

AiHane may review, remove, block access to, or temporarily or permanently restrict the relevant user account in relation to content that is unlawful, infringes rights, poses a security risk, or gives rise to suspicion of misuse.

7. REGARDING AI OUTPUTS

Outputs provided through AiHane are generated by automated systems. Such outputs may be erroneous, incomplete, similar, non-original, misleading, or in conflict with third-party rights.

AiHane does not guarantee that AI outputs are:

error-free,
original,
fit for a particular purpose,
fully compliant with the law,
non-infringing of third-party rights.

The user is obliged to carry out the necessary legal, commercial, technical, and editorial checks before using any generated outputs.

8. COMMERCIAL USE AND PLAN TERMS

Whether content generated on the platform is suitable for commercial use shall be determined according to the plan terms applicable to the user at the time the relevant content is generated. A change in plan shall not automatically and retroactively alter the commercial use status of previously generated content unless explicitly stated otherwise.

Usage limits, features, quotas, scope of access, and licence conditions relating to free and paid plans shall apply as announced on the platform.

9. PAID SERVICES, SUBSCRIPTION, AND PAYMENT

Certain services on the platform may be offered under paid plans or through a subscription model. The price, scope, usage limits, renewal period, and, where applicable, other conditions of paid plans shall be determined based on the information presented to the user at the time of purchase.

Payments may be processed through Stripe and/or similar third-party payment infrastructure providers. The user acknowledges that they may also be subject to the terms of use and privacy practices of the third-party providers used during the payment process.

If a paid plan is subscription-based, the subscription may renew at the end of the selected period unless explicitly stated otherwise. The user may cancel the subscription before the end of the current term; however, unless explicitly stated otherwise, such cancellation shall only affect the next renewal period, and the user shall continue to benefit from the services included in the relevant plan until the end of the current billing period.

Plan upgrades may take effect during the term, subject to the conditions separately specified on the platform. Downgrade requests, unless explicitly stated otherwise, shall not take effect within the current billing period and shall become effective in the next billing / renewal period.

The digital service shall begin to be performed after the payment is completed or once the relevant plan has been assigned to the user account. The user acknowledges that the purchased digital service may be activated in their account after payment.

Without prejudice to the rights arising from mandatory consumer protection legislation in force, no refunds shall be made for fees paid by the user for the current subscription / usage period. Likewise, plan downgrades shall not apply during the current term; such changes shall take effect only in the next renewal period.

10. INTELLECTUAL PROPERTY

All rights relating to the software, design, trademark, logo, domain name, interface, system architecture, and all other original elements of the AiHane platform belong to the relevant rights holders. The user may not reproduce, distribute, copy, process, reverse engineer, or use such elements for commercial purposes without authorisation.

11. CHANGES TO AND INTERRUPTION OF THE SERVICE

AiHane may temporarily or permanently modify, suspend, or terminate platform services for maintenance, updates, security, technical necessity, legal compliance, or operational reasons.

It is not guaranteed that the platform will always be uninterrupted, error-free, or continuously accessible.

12. SUSPENSION AND TERMINATION OF THE ACCOUNT

In the event of a breach of these Terms of Use, suspicion of misuse, security risk, request by an official authority, or legal necessity, AiHane may:

remove content,
restrict certain features,
temporarily suspend the account,
permanently terminate the account.

13. LIMITATION OF LIABILITY

Except where liability is mandatorily required by law, AiHane shall not be held liable for use of the platform, AI outputs, third-party services, data loss, loss of income, loss of reputation, or indirect damages.

The user acknowledges that the final responsibility for deciding to use the platform and the generated content rests solely with the user.

14. AMENDMENTS

AiHane reserves the right to amend these Terms of Use at any time. The current text shall become effective as of the date it is published on the platform.
